This End User License Agreement ("Agreement") is between you and Fedor Doubov. By downloading, installing, or using Pickscreen, you agree to it. If you do not agree, do not install or use Pickscreen.
1. What Pickscreen is (and what it is not)
Pickscreen is a window-management utility. It launches ordinary browser windows on your own computer, using your own browser and your own logged-in accounts, and arranges those windows into a grid that Windows itself draws.
Pickscreen:
- Provides no content. It has no media, no channels, and no streams of its own. Anything you watch comes from services you access yourself, in your own browser, under your own accounts.
- Grants no access to anything. If you cannot watch something in your browser without Pickscreen, you cannot watch it with Pickscreen.
- Does not decrypt, capture, record, store, or retransmit any video; does not circumvent any DRM or content-protection measure; does not block, skip, or alter advertising; and does not access, store, or transmit your streaming credentials. All playback occurs in your own browser, in each service's own player, under your own account.
Pickscreen is an independent utility. It is not affiliated with, endorsed by, or sponsored by any streaming service. All service names are trademarks of their respective owners, used only to identify compatibility.
2. License grant, licensed, not sold
Pickscreen is licensed to you, not sold. Subject to this Agreement, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use Pickscreen on Windows devices that you own or control, for personal, residential, non-commercial use only.
You may not use Pickscreen in any commercial establishment or any area open to the public, including bars, restaurants, retail spaces, sportsbooks, offices, waiting rooms, and similar venues, even if no fee is charged for viewing. (Streaming services' own terms prohibit viewing in these settings; this license does not extend to them.)
3. License tiers, trial, and activation
Pickscreen has three states, all governed by this Agreement:
- Free tier. Without a license key, Pickscreen runs with a limited number of simultaneous panes (currently 2). Free forever; no account or key required.
- Free 7-day trial. A trial license key gives you the full pane count (currently 16) for 7 days. When the trial key expires, Pickscreen returns to the free tier. It does not stop working. A trial key may be activated on 1 device.
- Paid license. A paid license key gives you the full pane count with no expiry. A paid key may be activated on up to 2 devices at a time. You can deactivate a device yourself through the customer portal to free a slot.
License keys are issued and managed by our merchant of record (Section 5). Pickscreen periodically validates your key over the internet. A brief loss of connectivity does not affect a valid license; if a key cannot be revalidated for an extended period (currently about 48 hours), Pickscreen falls back to the free tier until a check-in succeeds. Pickscreen never blocks you from launching the app.
You may not share, publish, or resell a license key, and you may not circumvent or attempt to circumvent the pane limit, trial expiry, activation limits, or any other license mechanism.
4. Your subscriptions, your responsibility
Use of any streaming service through Pickscreen requires your own active subscription to that service (where the service requires one). You are responsible for complying with each service's terms of use, including its limits on concurrent streams, its household and account-sharing rules, and its restrictions on where and how content may be viewed. Pickscreen does not and cannot exempt you from any of them.
Streaming services may change their technology, players, or terms at any time. We do not warrant that any particular service will remain viewable through Pickscreen, and a service becoming unviewable is not a defect in Pickscreen.
5. Purchases, payment, and refunds
Purchases and trial sign-ups are processed by Polar (polar.sh) acting as merchant of record. Polar handles checkout, payment, applicable taxes, and license-key delivery under its own terms and privacy policy. The current price is shown at checkout on pickscreen.tv.
Purchases include a 7-day refund window from the date of purchase. To request a refund, reply to your purchase receipt email within that window.
Sales are not available in every country. Checkout availability is determined at purchase time.
6. Privacy and data
Pickscreen does not collect your streaming credentials, browsing history, or viewing activity. License validation sends your license key and basic activation information (such as a device label) to our merchant of record's servers. Pickscreen may check for available updates by fetching a version file from pickscreen.tv.
7. Restrictions
You may not:
- copy (except for reasonable backup), modify, or create derivative works of Pickscreen;
- reverse engineer, decompile, or disassemble Pickscreen, except to the extent applicable law expressly permits it despite this limitation;
- rent, lease, lend, sell, sublicense, redistribute, or transfer Pickscreen or any license key;
- use Pickscreen to violate any law or any third party's terms of service; or
- remove or alter any proprietary notices in Pickscreen.
8. Updates and availability
We may provide updates, which may change or remove features, and this Agreement covers them unless a new agreement accompanies them. We are not obligated to provide updates or support, and we may discontinue Pickscreen at any time. Because paid licenses validate against our merchant of record's service, license validation depends on that service remaining available; the free tier does not.
9. Termination
This Agreement is effective until terminated. It terminates automatically if you materially breach it. We may also terminate or suspend a license key obtained fraudulently (for example, stolen payment or key resale). On termination you must stop using Pickscreen and delete your copies; the free tier's terms continue to apply to any continued use permitted under a fresh acceptance. Sections 10-12 survive termination.
10. No warranty
PICKSCREEN IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT PICKSCREEN WILL WORK WITH ANY PARTICULAR STREAMING SERVICE, BROWSER, OR WINDOWS CONFIGURATION, NOW OR IN THE FUTURE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR SUBSCRIPTIONS, ARISING OUT OF OR RELATING TO PICKSCREEN, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO PICKSCREEN WILL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR LICENSE (OR US $10 IF YOU PAID NOTHING). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU. NOTHING IN THIS AGREEMENT LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW.
12. Governing law and disputes
This Agreement is governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules. Any dispute arising out of or relating to this Agreement will be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
13. General
This Agreement is the entire agreement about Pickscreen and supersedes prior discussions. If a provision is unenforceable, the rest remains in effect. We may update this Agreement for future versions; the version that accompanies your copy governs that copy. You may not assign this Agreement; we may assign it in connection with a sale or reorganization of the product.
